Grill’d Relish Membership program terms

DEFINITIONS:

Individual is a private person, not a corporation, company, partnership, firm, association or society.

Benefits are the products, services, discounts and offers offered as part of the Relish Membership programme.

Benefit barcode is a barcode that houses a Relish members eligible offer. One offer can only ever be loaded on a single barcode.

Transaction is a transaction where a members Relish barcode details are provided for scanning during the transaction process

Privacy Policy means the Grill’d Privacy Policy published on the Grill’d website (https://www.grilld.com.au/legal-information/privacy-policy).

i) By providing your details (email and mobile) via the online registration form (www.grilld.com.au/relish) or Grill’d Application (App) and verifying you’re your details, you agree to these Terms and Conditions.

ii) There is a strict limit of one (1) registered Account per Member/Individual. Each account requires an independent email address and mobile phone number that needs to be verified.

iii) The Grill’d Relish Membership program is available in all company owned and franchise permanent or temporary restaurant’s in Australia.  

iv) An individual can become a Grill’d Relish Member via the following avenues:

a. registering to become a Member on the Grill'd website (www.grilld.com.au/relish)

b. downloading the Grill’d App for IOS or Android and following the prompts to register and activate your Membership

 v) Individuals under 18 years old must have parental/guardian approval to register for the Grill’d Relish Membership. The under 18 individual’s the parent/guardian must read and consent to these Terms and Conditions.

vi) A period of a membership is from 1 January – December 31.

 vii) Relish Members are entitled to a free Birthday beverage on the day of their birthday and for 14 days after their birthdate upon presentation of their benefit barcode in the App or in the email and with a purchase of a main menu item. The free Birthday beverage cannot be redeemed on any other day regardless of external circumstances including but not limited to public holidays, store closures etc. This free Birthday beverage is non-transferable and cannot be exchanged for cash. Grill’d do not take responsibility for incorrectly entered birth dates during the registration process.

viii) Additional benefits and entitlements may be offered at the absolute discretion of Grill’d.

ix) Upon website and app registration to the Grill’d Relish Membership, Members will receive a Welcome email that will contain the Members unique barcode that they can use to scan to register their transaction. App Members will also be able to access their Member barcode in the App.

x) The redeemed benefits will be delivered to the Member in one of the following ways, as determined by Grill’d: •    by email (by code redeemable through a store) to the Member’s registered login email address; or 

•    by App (which may deliver the benefit directly by a code redeemable through a store);

xi) Delivery of benefits will take place in Australia only.    

xii) Benefits will be awarded to the Member named on the redemption form, unless otherwise specified.

xiii) To the extent permitted by law, Grill’d will not be liable to any Member for any benefit which the Member fails to receive due to factors outside of the reasonable control of Grill’d. Grill’d does not take responsibility if a benefit is used by an individual other than the individual whom the benefit is intended.

xiv) A benefit cannot be exchanged or returned.

xv) If a Member redeems a benefit and that benefit is unavailable, Grill’d reserves the right to substitute a different item of similar value/type.  

xvi) All products advertised as benefits at www.grilld.com.au/relish may be modified or changed at any time by Grill’d.

xvii) Any values attributed to any benefit are correct as at the time of publication, but no responsibility is accepted for any variation in the value of any benefits.

xviii) Grill’d is not liable for any loss, theft of or damage to any benefit sustained in the course of delivery.

xix) Grill’d benefits vouchers have no monetary value, or other value, and cannot be redeemed for cash.

xx) A Member's account may only be used by the Member in whose name the account is registered. Multiple individuals cannot share one Member's benefit voucher.

xxi) Grill’d is not liable for any unauthorised use of a Member's account, user name or password by third parties, nor is it liable for unauthorised use of a benefit barcode sent to a Member.

xxii) Grill’d reserves the right to verify the validity of proposed redemptions and to disentitle any Member who tampers with or subverts the redemption process or who submits a redemption request that is not in accordance with these Terms and Conditions.

xxiii) All expenses incurred by a Member as a result of redemption of a benefit from www.grilld.com.au/relish are the responsibility of the Member.

xxiv) Benefits that are available for redemption from www.grilld.com.au/relish may require that the Member have certain hardware or software to receive or access the benefit.

xxv) Grill’d is not responsible should the Member not have adequate hardware or software to receive such a benefit.

xxvi) Benefits are subject to any terms and conditions applicable to the specific benefit.

xxvii) Members will be notified via email or App message when they qualify for a benefit. Members need to scan each benefit’s unique barcode at restaurant to redeem the specific benefit such as free Birthday drink.     

xxviii) Every effort will be made at restaurants to ensure Grill’d Relish benefits are correctly awarded, however, Grill’d takes no responsibility for technical errors associated with redeeming benefits.

xxix) The Grill’d Relish benefit vouchers should be treated like cash. Unless otherwise required by law or permitted by this agreement, any benefit vouchers associated to a Members Grill’d Relish Membership is non-refundable and may not be redeemed for cash. No interest or any other earnings on funds deposited to a Relish Membership will accrue, be paid or be credited to you by Grill’d Pty.Ltd.

xxx)       Should a password be lost or forgotten, Relish Members should go to the registered Members section of the Grill’d website www.grilld.com.au/relish or App where they will be required to enter their email address and click on 'lost password'. Their password will then be sent to their nominated email address associated with their Account.

xxxi) By becoming a Grill’d Relish Member, you agree to the collection, use and disclosure of personal information in accordance with the Grill’d Privacy Policy.

xxxii) Members whose Account has not been used for 20 consecutive months since their last transaction will be contacted at that time to encourage them to make a transaction to prevent their account expiring. A Members account will expire if no transactions are made on their Account for a consecutive period of 24 months. Grill’d will automatically deduct and invalidate benefit vouchers from such an Account after 24 months, with any accrued benefit vouchers and other entitlements being forfeited. For the avoidance of doubt, the Account will not be terminated and the Member will retain their Account even after their benefit vouchers expire. 

xxxiii) From time to time, Grill’d may conduct various benefit offers, promotions and discount offers which will be open to total/selected verified Members only. 

xxxiv) Members may receive personalised offers depending on the data captured against their Member record or what Grill’d think you will enjoy. For this reason, one Member’s offer may be different to another. 

xxxv) Benefit vouchers offered under this Program are not transferable, exchangeable or redeemable for cash. Benefit vouchers accrued in multiple Accounts cannot be combined.

xxxvi) The barcode in the App and email will be accepted in Grill’d restaurants across Australia. From time to time some restaurants may be prevented from attributing a transaction to a Member due to circumstances beyond their control (e.g internet outage). If a restaurant is not able to facilitate attributing a transaction to a Members account, Members will be required to visit and purchase at a restaurant that is able to attribute a transaction to a Members account.

xxxvii) Grill’d reserves the right to refuse a barcode should we believe that the use is unauthorised, fraudulent or otherwise unlawful.

xxxviii) No fees will be charged by Grill’d for the issue, registration, activation or use of the App or Program website. Members are responsible for any costs charged by their service provider for Internet access to use the App or access the Program website.

xxxix) Members can check their Benefit vouchers earned through the App or the emails they receive.

xl)  Grill’d reserves the right to alter the Terms and Conditions of the Relish Membership Program at any time by notifying Members through email, App or website. This Program, including any offer or promotion conducted under the Program will continue until such time it is terminated by Grill’d. Should the Program be suspended or cancelled at any time, Grill’d will notify Members via email or the relevant section of the Grill’d website.

 xli) To the extent permitted by law, all terms, conditions, warranties and representations that might otherwise be granted or implied in relation to benefits or related to the Grill’d relish Membership Program in any way by law, are hereby expressly excluded. However, these conditions do not exclude or limit any liability that cannot be excluded or limited, or which cannot be excluded or limited except to a limited extent, by law including liability under the Competition and Consumer Act 2010 (Cth). Where such statutory provisions apply, to the extent to which Grill’d is entitled to do so, Grill’d liability will be limited at its option to (a) in the case of a supply of goods: (i) the replacement of the goods or the supply of equivalent goods; (ii) the payment of the cost of replacing the goods or of acquiring equivalent goods; (iii) the repair of the goods; or (iv) the payment of the cost of having the goods repaired, and (b) in the case of services: (i) the supply of the services again; or (ii) the payment of the cost of having the services supplied again. It is a condition of Member's redemption of any benefit that the Member must comply with all the conditions of use for the benefit, and subject to law, the requirements of the supplier of the benefit.

xlii) Grill’d reserves the right, at any time, to verify the validity of Members, registrations, verification of accounts, and benefit vouchers and redemption (including a Member’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Member who Grill’d has reason to believe has breached any of these Terms and Conditions, tampered with the registration, benefit voucher redemption and/or account verification process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Program. Errors and omissions may be accepted at Grill'd’s discretion. Failure by Grill’d to enforce any of its rights at any stage does not constitute a waiver of those rights. Grill’d’s legal rights to recover damages or other compensation from such an offender are reserved.

xliii) Incomplete or indecipherable Member registrations will be deemed ineligible for this Program or deemed invalid.

xliv) If there is a dispute as to the identity of a Member, Grill’d reserves the right, in its sole discretion, to determine the identity of the Member.

xlv) If for any reason the Program is inoperable (including but not limited to computer virus, bugs, tampering, unauthorised intervention, fraud, and technical failures) Grill’d reserves the right in its sole discretion to disqualify any individual who tampers with Grill’d systems, and to cancel, terminate, modify or suspend the Program. This includes causes beyond the control of Grill’d which corrupts or affects the administration security, fairness, integrity or proper conduct of this Program.

xlvi) Grill’d decision in relation to all matters arising under this Program is final and binding, and no correspondence will be entered into.

xlvii) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Grill’d (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of participation in the Program. This includes any technical difficulties or equipment malfunction of any telephone network or line, computer system, equipment, server or provider, software, technical problem or traffic congestion on the Internet (whether or not under Grill’d control), any theft, unauthorised access or third party interference, redemption of benefit vouchers, any registration or benefit claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Grill’d) due to any reason beyond the reasonable control of Grill’d, use of a barcode, accepting/using/taking a benefit or other entitlement, any tax liability incurred by a Member, or accepting/using/taking a discount offer under the Program, except where liability cannot be excluded by law.

xlviii) Grill’d will not be held responsible for any tax liability incurred by a Member in connection with this Program, including in relation to any benefit, discount or entitlement offered.

xlix) Grill’d will not be held liable for any communication to any Member that is late, lost or misdirected for any reason, including but not limited to, spam filters operating on a Member's email account or other system configuration problems.

l)  Grill’d is not responsible for any problems or technical malfunction of any telephone network or line, computer system, equipment, server or provider, software, technical problem or traffic congestion on the Internet (whether or not under Grill’d control). This includes (but is not limited to) any injury or damage to a Member's or any other individual's computer related to or resulting from participation in or down-loading of any materials in this Program.

li) These Terms and Conditions are to be read in conjunction with, and subject to, any additional Terms and Conditions governing any particular benefit, promotion, discount or offer operated by Grill’d. In the case of any inconsistencies, these Terms and Conditions will prevail.

lii)  Information collected from Members at the time of signing up to the Program is subject to the privacy policy listed at www.grilld.com.au/privacy and this clause. Grill’d collects personal information in order to conduct the Program and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and service providers. Participating in the Program is conditional to providing this information. Grill’d may, for an indefinite period, unless otherwise advised, use the information provided for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages.

liii) Grill’d decisions in relation to all matters arising under this Program are final and binding, and no correspondence will be entered into.

liv) Grill’d reserves the right to change or revise these Terms and Conditions at any time.

lv) This Program is being run by Grill’d Pty Ltd, ACN 106 297 394 of Level 2, 4-10 Amsterdam St, Richmond, VIC 3121 (“Grill’d”).
